1. Acceptance of these terms
By downloading or using the Atrip mobile app or this website (together, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
2. The service
Atrip is a mobile app and companion website for keeping a personal record of your travels — the flights, trains, and cruises you take, logged in one place over time. We may add, change, or remove features at any time as the app evolves.
3. Your account
You need an account to use Atrip — you can sign up with Google, Apple, or an email address and password. You're responsible for keeping your login credentials secure and for all activity that happens under your account. You must be at least 13 years old to create an account.
4. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the operation of the Service
- Use the Service to store or transmit content that is unlawful, defamatory, or infringes someone else's rights
5. Purchases and subscriptions
Atrip is currently free to download and use, with no in-app purchases or subscriptions. If we introduce paid features in the future, we'll describe them here and make sure you see pricing before you're ever charged.
6. Your content
You keep ownership of any content you create or store using Atrip, including your profile information and any travel history you record. By using the Service, you grant us the limited licence needed to store, back up, and display that content back to you — that's it. We don't share your content with other users or the public.
7. Intellectual property
The Service, including its design, code, and branding, belongs to Simon David, trading as Studio David, and is protected by applicable intellectual property laws. These terms don't grant you any rights to our trademarks or branding.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or fit for any particular purpose. Atrip is a personal record-keeping tool, not a booking service — we don't guarantee the accuracy of flight, train, or cruise details you enter or that are shown to you, and you should always confirm travel details with the relevant airline, railway, or cruise operator.
9. Limitation of liability
Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, and to the maximum extent otherwise permitted by law, Simon David (trading as Studio David) will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, and our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.
10. Termination
You can stop using the Service and delete your account at any time, directly from the app's Profile screen — see the data deletion page for details. We may suspend or terminate your access if you breach these terms, with notice where reasonably possible.
11. Governing law
These terms are governed by the laws of Queensland, Australia, and any disputes will be resolved in the courts of Queensland.
12. Changes to these terms
We may update these terms from time to time. When we do, we'll update the date at the top of this page and, for significant changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated terms.
